Les étudiant(e)s sont priés de se conformer aux standards suivants:
1. Wise Scholars est affilié / accrédité auprès de diverses institutions chrétiennes à travers le monde. Nous aidons à former nos étudiants à développer leurs compétences et leurs appels pour atteindre le dessein de Dieu dans la vie et le ministère.
2. Grâce à nos partenariats avec des universités, ministères, instituts et collèges bibliques, nous formons ainsi nos étudiants dans un cadre de théologie chrétienne et de l’œuvre de Dieu pour conduire le monde vers Christ.
3. Tout paiement d’études fait sur les cours ou les ressources chrétiennes et la bibliothèque, est volontairement donné comme un don pour avancer l’œuvre de Dieu au sein de la vision de Wise Scholars.
4. Les étudiants étudient au travers Wise Scholars pour recevoir leurs diplômes théologiques au travers de Wise Scholars ou des universités bibliques sous leurs conditions et termes.
5. Les étudiants sont priés de vérifier leurs satisfactions de la foi et la doctrine avant d'amorcer leurs études.
6. Les cours dispensés sont uniquement de caractère Biblique et reflètent la vie chrétienne sous la crainte de Dieu.
7. Wise Scholars ne sera pas ténu responsable d’aucune réclamation contraire à ses closes et doctrine de la foi.
8. Wise Scholars développe chez les croyants une relation forte et profonde avec Dieu pour les faire réussir dans leurs appels divins. Nous formons ainsi nos étudiants dans un contexte de l’église chrétienne et de conduire le monde à Christ.
9. Wise Scholars souscrit à l’acte national et international de séparation de l’Église et de l’État et à la Charte des droits et libertés de la religion.
10. Wise Scholars offre un service de mentorat et de tutelle pour les érudits bibliques qui souhaitent réaliser avec succès leur appel divin dans le ministère de l'Église de notre Seigneur Jésus-Christ.
11. Tous les diplômes sont obtenus avec mérite. Ceci est réalisé par des cours obligatoires qui doivent être suivis sous le mentorat et la tutelle de Wise Scholars.
12. Tous les étudiants sont considérés comme des étudiants en ligne et sont inscrits dans nos diverses institutions chrétiennes affiliées, collèges bibliques et séminaires d'où tous les certificats, diplômes et grades sont délivrés en tant que tels.
13. Nous n'encadrons pas nos étudiants pour un travail laïque ou un service confessionnel. Nous chercherons à fournir un solide fondement théologique à partir duquel nos étudiants peuvent accomplir leur dessein et appel divin.
14. Nous ne sommes pas responsables des règles et problèmes que les étudiants peuvent avoir avec leurs universités chrétiennes ou collèges bibliques respectifs.
15. Les étudiant(e)s ne sont pas autorisés à faire des commentaires ou notes doctrinales personnelles sur le travail soumis. Les points seront déduits à cause de ça.
16. Si la réponse ne peut pas être trouvée dans le cours, il est supposé que l’étudiant(e) doit faire une lecture supplémentaire dans la Bible aussi bien que les autres ressources des matières. Cela doit être signalé. Ce cas est une exception dans nos règles et se produira très rarement.
17. Les examens ne seront pas télécopiés, ou photocopiés. Les feuilles originales des examens en ligne ou traditionnelles, doivent être répondues et soumises pour la correction. Les essais et/ou autres tâches assignées doivent être écrit selon les recommandations des instructeurs.
18. C'est une condition aux étudiant(e)s (de certificat ou diplôme) de présenter et achever 10 modules, et ceux ou celles de niveaux de Licence de présenter et achever 15 modules. La période d’une année académique est de 10 mois pour les certificats et diplôme, et 15 mois pour la licence. L’année académique est comptée depuis le jour de l’inscription, et en ligne ceci est noté sur le portail de compte de chaque étudiant. Cela fait la moyenne d’un module par mois. S'il vous plaît gardez cette allure à tout moment.
19. Bien qu'il soit dit que les étudiants commencent leurs études à tout moment et à leur rythme, une fois inscrits, votre année universitaire commence le premier jour de votre inscription. il est important de souligner que lorsque vous demandez une prolongation de cours, un examen ou un report de travail, cela ne prolonge pas votre année universitaire. les étudiants doivent s'assurer qu'ils font de leur mieux pour terminer leurs études dans l'année académique qui leur est attribuée. En cas de non-respect, l'année académique sera annulée et considérée comme un échec. Une fois la période d’études s’écoule sans terminer les études, l’étudiant (e) est considéré (e) comme il (elle) a échoué ses études ! Pour ce fait, il (elle) doit reprendre ses études avec une nouvelle inscription et paiement normal des études.
20. Les étudiant(e)s par correspondance doivent diriger toutes leurs questions à travers leurs Collèges Bibliques et ne doivent pas contacter directement nos bureaux nationaux. Pour ceux qui sont en ligne ils peuvent communiquer directement avec leur administrateurs ou instructeurs à partir de leurs portails de compte d’études en ligne.
21. Les étudiant(e)s par correspondance doivent mentionner leurs numéros d’étudiant aussi bien que leurs Collèges Bibliques sur tout travail soumis et préférablement sur chaque page soumise.
22. La correction est aussi basée sur l’aspect de la présentation du travail. Pour ceux qui sont en ligne, notre système de LMS fait la correction immédiatement et les résultats sont instantanés. Vouloir respecter toutes les étapes sur votre cours en votre portail d’études. Ne pas sortez les étapes si vous êtes en ligne comme chaque unité ne donne accès à l’autre qu’après avoir être effectuée.
23. Les étudiant(e)s sont exigés de garder une copie de tout leur travail soumis. Nous ne sommes pas responsables de la perte du travail dans nos bureaux.
24. Les étudiant(e)s par correspondance doivent utiliser un stylo bleu ou noir seulement. Les tâches assignées qui sont complétées avec un stylo rouge seront rendues nulles et sans être corrigées.
25. Nous ne sommes pas obligés de remettre des feuilles des travaux corrigés des étudiant(e)s comme ceux-ci restent à nos bureaux où tous les travaux sont modérés pour assurer que des standards adéquats sont respectés et maintenus. Nous pouvons cependant envoyer les relevés des notes.
26. Notre bureau réserve le droit de vérifier tout étudiant et prendre des décisions adéquates. Les directeurs doivent assurer l'intégrité financière et doivent garder l’original ou un registre certifié pour l'inscription de chaque étudiant et toute documentation apparentée.
27. Les étudiant(e)s qui font le cours du Certificat doivent compléter toutes les questions des choix multiples, essais et tâches assignées.
28. Les étudiant(e)s qui font le cours de Diplôme doivent compléter toutes les questions d’essais, devoirs et examen des choix multiples.
29. Les étudiant(e)s qui font la licence doivent compléter toutes les questions des choix multiples, leurs essais, projets et révision.
30. Les étudiant(e)s qui font la Maitrise et le Doctorat doivent conduire une dissertation ou une thèse aussi bien que se conformer aux exigences détaillées pour leurs recherches et défenses.
31. Pour les étudiants par correspondance, les examens des certificats et diplômes sont corrigés par les enseignants des collèges bibliques, cependant, pour les licences, maitrises et doctorats toutes leurs réponses aux questions de choix multiples , essais, projets, thèse et dissertation aussi bien que toutes les autres exigences doivent être envoyées à notre bureau pour la correction. Le travail incomplet ne sera pas accepté.
32. Avant de commander les cours, faites le versement total pour le montant de cours demandé dans notre compte bancaire. S'il vous plaît soumettez votre demande clairement avec indication du nom de votre Collège Biblique, le code pour la référence du module que vous demandez et le nombre des cours exigé par module. Nous exigeons aussi les noms des étudiants pour qui les cours sont prévus.
33. Pour les étudiants par correspondance, vouloir vous servir de notre formulaire de demande de cours pour toute demande de vos cours (les cours qui ne sont pas demandés avec nos formulaires ne seront pas accordés)
34. Pour les étudiants en ligne, vouloir vous servir de votre messagerie sur votre compte d’études ou notre courriel de Wise Scholars pour toute demande de vos cours.
35. Les cours doivent être demandés au moins 5 jours ouvrables avant que les classes commencent. S'il vous plaît faites des arrangements adéquats pour les cours qui doivent être envoyés par le moyen de poste car cela peut prendre 10 jours ou plus pour vous atteindre.
36. Le paiement doit être d’abord fait dans notre compte bancaire avant de recevoir un cours. Vouloir envoyer votre fiche de virement à nos bureaux nationaux.
37. Mettez votre numéro d’étudiant ou votre nom comme référence à votre fiche de virement !
38. Les directeurs de Collèges Biblique peuvent commander des certificats une fois par année pour leurs étudiants et organiser leurs propres cérémonies de la collation et remise des diplômes.
39. Les étudiants peuvent commencer leurs études à n’importe quel moment de l’année, et la collation des diplômes suivra dès l’achèvement du programme bien suivi.
40. Wise Scholars opère en ligne et peut ne pas organiser chaque année des cérémonies de remise des diplômes dans toutes les nations du monde.
41. La participation à la collation des grades n'est pas obligatoire. Vouloir vous enquérir chaque fois sur les infos de la collation auprès de vos admirateurs comme cela peut changer à chaque année.
42. Au cas qu’il y est une collation académique dans un lieu quelconque, les frais de la collation des grades, les dépenses logistiques et autres sont payables et couverts par l’étudiant concerné.
43. Les certificats et diplômes sont expédiés aux étudiants ayant achevé bien leur programme à leur propre frais.
44. S'il vous plaît notez qu’il y a un coût nominatif pour chaque certificat délivré.
45. Les examens des étudiant(e)s sont placés à la fin de chaque cours. Les professeurs peuvent choisir de permettre aux étudiants de répondre aux examens dans leur propre temps. Les étudiants sont autorisés à faire usage de leurs cours lors de l'examen. Cependant, ils ne sont pas autorisés de travailler en groupe, chacun doit soumettre son propre travail pour être corrigé. Tout travail qui est identique au travail d'un autre étudiant sera annulé.
46. Pour les étudiants par correspondance leurs examens sont corrigés à nos bureaux. Tous les examens, testes, projets et travaux seront envoyés à nos bureaux pour ce but. Nous vous informerons des résultats dans un temps d’un cycle de deux mois.
47. Tous nos étudiants ou Collèges Bibliques sont demandés de faire le paiement total en avance. Cela peut être accompli avec succès si les directeurs rassemblent le paiement de leurs étudiant(e)s avant qu’un cours commence. Ce n'est pas bon de donner un cours aux étudiant (e)s s’ils ne l'ont pas encore payé. Beaucoup de nos Collèges Bibliques ont rendu effectif ce système avec succès et nous encourageons tout le monde à opérer sur un arrangement d’un paiement direct avec nos bureaux nationaux de WISE SCHOLARS INTERNATIONAL. Mettez le numéro et le nom de l’étudiant comme référence à votre fiche de virement !
48. Les étudiants sont priés de ne pas s'impliquer dans une affaire illégale avec les lois d'un pays: tout étudiant impliqué dans la falsification de nos services et de notre contenu, sera sans avertissement expulsé indéfiniment de Wise Scholars et fera face à une infraction pénale.
49.POLITIQUES DE RETRAIT ET DE RUPTURE
Les étudiants qui cessent d'assister à tous leurs cours sont tenus de faire officiellement une pause ou de se retirer du Programme Tutoriel.
Si vous envisagez de vous retirer ou d'abandonner des cours, veuillez sélectionner l'option appropriée ci-dessous pour déterminer l'impact de cette décision sur vos frais de scolarité s'ils sont déjà payés.
Veuillez contacter le bureau de l'administration pour plus d'informations sur le retrait officiel ou l'abandon d'un cours du programme de scolarité.
1. FAIRE UNE PAUSE OU ABANDONNER UN COURS
Vous pouvez faire une pause jusqu'à deux mois pendant vos études. Pour prendre soin des personnes que vous aimez, vous devez également prendre soin de vous.
Si vous envisagez de faire une pause dans le programme de tutorat ou d'abandonner des cours, veuillez contacter le bureau de l'administrateur pour plus d'informations sur la façon de faire officiellement une pause avec Wise Scholars.
Nous faisons tout pour que vous continuiez à étudier. Lorsque vous postulez pour une pause d'études, nous en discuterons avec vous et essaierons de vous aider à trouver des moyens de continuer à étudier. Ensemble, nous conviendrons de la date à laquelle vous recommencerez.
Souvenez-vous simplement de ce qui suit :
A. Un étudiant ne peut pas faire de pause dans les trois premiers mois suivant son inscription.
B. Le compte étudiant doit être à jour avec les paiements avant qu'une pause puisse être prise.
C. L'étudiant ne peut pas prendre de pause de plus de deux mois.
2. RETRAIT OFFICIEL
Si vous vous retirez de scolarité, vous devez contacter le bureau de l'administration pour commencer le processus de retrait officiel et établir votre date de retrait.

3. RETRAIT NON OFFICIEL
Si vous cessez d'assister à tous vos cours pendant plus de deux mois et que vous ne terminez pas le processus de retrait officiel, vous serez considéré comme un retrait non officiel. Les étudiants sont considérés comme s'étant retirés officieusement s'ils ne terminent avec succès aucun de leurs cours, ont cessé d'assister aux cours et n'ont terminé aucun cours au point de 60% des cours de scolarité sans déposer de demande de retrait officiel endéans deux mois à Wise Scholars, comme requis…
Notez:
A. Si vous cessez d'assister à tous vos cours, vous devez vous retirer officiellement du programme académique endéans deux mois, vous êtes considéré comme vous avez échoué votre grade académique, vous devez recommencer les cours tout en payant le frais académique total ou faute de quoi vous perdrez votre adhésion d’étudiant à Wise Scholars sans remboursement.
B. Les étudiants qui assistent à leurs cours jusqu'à 60% et se retirent officieusement pendant plus de deux mois et souhaitent reprendre leurs études seront tenus de payer encore jusqu'à 50% des frais académiques prescrits s'ils étaient entièrement payés auparavant.
C. Les étudiants n'ayant jamais assisté à aucun de leurs cours et n'ayant terminé aucun cours endéans deux mois et souhaitant recommencer leur programme de tutorat, ils sont donc tenus de payer de nouveau 100% des frais académiques perçus pour le programme académique.
D. Si l’étudiant(e) n’a pas terminé son cours faute au temps, il ou elle peut faire un recours pour une prorogation de son cours. Cependant, il est important de noter que le cours ne peut qu’être proroger qu’une fois pour 5 jours seulement.
50. Nos conditions d’utilisation sont amendées régulièrement pour une bonne amélioration et un respect strict aux services que nous fournissons aux étudiants en Jésus Christ notre Seigneur.

Exams must be original, and correspondence students must communicate through their biblical colleges. Students are required to adhere to strict deadlines for requesting courses and making payments. Withdrawal from the program requires an official procedure. Fees are associated with certificate issuance, and Wise Scholars does not necessarily organize graduation ceremonies every year. Students are requested to comply with the following standards:
1. Wise Scholars is affiliated/accredited to various Christian institutions around the world. We help train our students to develop their skills and their calling to achieve God's plan in life and ministry.
2. Through our partnerships with biblical universities, ministries, institutes and colleges, we train our students in a framework of Christian theology and God's work to lead the world to Christ.
3. Any payment of studies made on Christian courses or resources and the library, is voluntarily given as a gift to advance god's work within the vision of Wise Scholars.
4. Students study through Wise Scholars to receive their theological degrees through Wise Scholars or Bible universities under their terms and conditions.
5. Students are asked to check their satisfactions with faith and doctrine before starting their studies.
6. The courses taught are only of a Biblical character and reflect Christian life under the fear of God.
7. Wise Scholars will not be tenuously responsible for any claim contrary to its closed and doctrine of the faith.
8. Wise Scholars develops in believers a strong and deep relationship with God to make them succeed in their divine calling. We thus train our students in a context of the Christian church and to lead the world to Christ.
9. Wise Scholars subscribes to the national and international act of separation of church and state and the Charter of Rights and Freedoms of Religion.
10. Wise Scholars offers a mentoring and guardianship service for biblical scholars who wish to successfully fulfil their divine call in the ministry of the Church of our Lord Jesus Christ.
11. All diplomas are earned degrees with merit. This is achieved through mandatory courses that must be followed under the mentorship and tutorship of Wise Scholars.
12. All students are considered online students and are enrolled in our various affiliated Christian institutions, Bible colleges and seminaries from which all certificates, diplomas and degrees are issued as such.
13. We do not mentor our students for secular work or denominational service. We will seek to provide a solid theological foundation from which our students can fulfill their divine purpose and call.
14. We are not responsible for the rules and problems that students may have with their respective Christian universities or Bible colleges.
15. Students are not allowed to make personal doctrinal comments or notes about the work submitted. Marks will be deducted because of that.
16. If the answer cannot be found in the course, it is assumed that the student must make an additional reading in the Bible as well as other resources of the subjects. This needs to be reported. This case is an exception in our rules and will occur very rarely.
17. The exams will not be faxed or photocopied. The original sheets of online or traditional exams must be answered and submitted for correction. Essays and/or other assigned tasks must be written according to the instructors' recommendations.
18. It is a condition for students (certificate or diploma) to present and complete 10modules, and those at Bachelor's levels to present and complete 15 modules. The period of an academic year is 10 months for certificates and diplomas, and 15 months for the bachelor's degree. The academic year has been counted since the day of registration, and for the online students this is noted on each student's account portal. That's the average of one module per month. Please keep this pace at all times.
19. Although it is said that students begin their studies at any time and at their own pace, once enrolled, your academic year begins on the first day of your enrollment. it is important to stress that when you request an extension of course, exam or postponement of work, it does not extend your academic year. students must ensure that they do their best to complete their studies in the academic year allocated to them. In case of non-compliance, the academic year will be canceled and considered a failure. Once the study period goes by without completing the studies, the student is considered to have failed his or her studies! For this reason, he (she) must resume his/her studies with a new registration and normal payment of studies.
20. Correspondent students should direct all their questions through their Bible Colleges and should not contact our national offices directly. For those who are online they can communicate directly with their administrators or instructors from their online study account portals.
21. Students by mail must mention their student numbers as well as their Bible Colleges on any submitted work and preferably on each submitted page.
22. The correction is also based on the aspect of the work presentation. For those who are online, our LMS system makes the correction immediately and the results are instantaneous. Want to respect all the steps on your course in your study portal. Do not skip the units when studying your online module as each unit only gives access to the other unit after being performed.
23. Students are required to keep a copy of all their submitted work. We are not responsible for the loss of work in our offices.
24. Mail-order students should only use a blue or black pen. Assigned tasks that are completed with a red pen will be rendered null and void and not corrected.
25. We are not required to provide corrected work sheets of students as they remain at our offices where all work is moderated to ensure that adequate standards are met and maintained. We can, however, send the transcripts.
26. Our office reserves the right to check any student and make appropriate decisions. Directors must ensure financial integrity and must keep the original or certified register for each student's registration and related documentation.
27. Students who take the Certificate course must complete all questions of multiple choices, essays and assigned tasks.
28. Students taking the Diploma course must complete all essay, homework and multiple-choice questions.
29. Students who do the bachelor's degree must complete all the questions of multiple choices, their essays, projects and revisions.
30. Students who do the Master's and PhD must conduct an dissertation or thesis as well as comply with the detailed requirements for their research and defenses.
31. Correspondent students on certificates and diplomas, their examinations are corrected by teachers of Bible colleges, however, for bachelors, masters and doctorates all their answers to multiple choice questions, essays, projects, thesis and dissertation as well as all other requirements must be sent to our office for correction. Incomplete work will not be accepted.
32. Before ordering the courses, make the full payment for the course requested in our bank account. Please submit your application clearly with the name of your Bible College, the code for the reference of the module you are requesting and the number of courses required per module. We also require the names of the students for whom the courses are requested.
33. Correspondent students, must use our course application form for any application for your courses (courses that are not requested with our forms will not be granted)
34. Online students must use their email on their study account or our wise Scholars email for any request made for a course.
35. Courses must be requested at least 5 working days before classes begin. Please make adequate arrangements for courses that need to be sent through post as it may take 10 days or more to reach you.
36. The payment must first be made in our bank account before receiving a course. Please send your proof of payment to our national offices.
37. Put your student number or name as a reference to your bank deposit or transfer!
38. Bible College directors can order certificates once a year for their students and organize their own snack and graduation ceremonies.
39. Students can begin their studies at any time of the year, and graduation will follow as soon as the well-attended program is completed.
40. Wise Scholars operates online and may not hold annual graduation ceremonies in all nations of the world.
41. Participation in graduation is not mandatory. Please inquire every time on the graduation ceremonies with your administrator as this can change every year.
42. In the event that there is an academic graduation in any place, the costs of the graduation, logistical and other expenses are payable and covered by the student concerned.
43. Certificates and diplomas are sent to students who have completed their program at their own expense.
44. Please note that there is a nominal cost for each certificate issued.
45. Students' exams are placed at the end of each course. Teachers can choose to allow students to take exams in their own time. Students can use their courses during the exam. However, they are not allowed to work in groups, each must submit their own work to be corrected. Any work that is identical to another student's work will be cancelled.
46. All correspondent students, their exams are corrected at our offices. All exams, tests, projects and work will be sent to our offices for this purpose. We will inform you of the results within a two-month cycle.
47. All our students or Bible Colleges are asked to make the full payment in advance. This can be done successfully if principals collect payment from their students before a course begins. It is not good to give a course to students if they have not yet paid for it. Many of our Bible Colleges have successfully made this system effective and we encourage everyone to operate on a direct payment arrangement with our national offices of WISE SCHOLARS INTERNATIONAL. Put the student's number and name as a reference to your bank deposit or transfer !
48. Students are requested to not get involved in any illegal matter with any country’s laws: Any student involved into tampering with our services and content, will be without warning expelled indefinitely from Wise Scholars and face a criminal charge.
49. WITHDRAWAL AND BREAK POLICIES
Students who stop attending all their classes are required to officially take a break or withdraw from the Tutorship Program.
If you are considering withdrawing or dropping courses, please select the appropriate option below to determine how this decision will impact your academic fees if already paid.
Please contact the Admin’s office for more information on officially withdrawing or dropping a course from the tuition program.

You can take a break for up to two months during your studies. To look after the people you care for, you also need to take care of yourself.

We do everything to keep you studying. When you apply for a study break, we will discuss it with you and try to help you find ways to keep studying. Together we will agree the date on which you will start again.
Just remember the following:
A. A student cannot take a break within the first three months after registration.
B. Student Account has to be up to date with payments before a break can be taken.
C. Student cannot take a break for longer than two months.
2. Official withdrawal
If you withdraw from the academic tuition, you must contact the Admin’s Office to begin the official withdrawal process and establish your withdrawal date.
Please contact the Admin’s office for more information on officially withdrawing from Wise Scholars tutorship.
3. Unofficial Withdrawal
If you stop attending all your classes for more than two months and fail to complete the official withdrawal process, you will be considered as an unofficial withdrawal.
Students are considered to have unofficially withdrawn if they do not successfully complete any of their courses, stopped attending classes, and did not complete any coursework as of the 60% point of the academic tuition without filing to officially withdraw within two months to Wise Scholars , as required.
Please note:
A. If you stop attending all of your classes, you are required to officially withdraw within two months from the academic program , falling to do so you will be considered as failing your grade, you will have to start your program and pay full academic fees or you will lose your student membership from Wise Scholars with no refund.
B. Students who attend their classes tuition up to 60% and unofficially withdraw for more than two months and would like to restart their studies will be required to repay up to 50% of the academic fees prescribed if they were fully paid before.
C. Students who never attended any of their classes and did not complete any coursework within two months and would like to restart their tutorship program again, they are therefore required to repay 100% of the academic fees received for the academic program.

MOODLECLOUD TERMS OF SERVICE
These Terms of Service (“Terms”) are between Moodle Pty Ltd (ABN 55 116 513 636) (referred to as “Moodle”, “We”, “Us” and “Our”) and the individual, organisation or other entity agreeing to these Terms (referred to as “You” or “Your”), collectively referred to as the Parties or each a Party. These Terms govern the access and use of the cloud hosting services via Our websites including moodlecloud.com (“MoodleCloud Services” or “Website”).
- ACCEPTANCE
- By signing up to access and use the MoodleCloud Services You agree to these Terms. If You do not agree to these Terms, You should notify Us and cease accessing the MoodleCloud Services immediately. If You are agreeing to these Terms on behalf of an organisation, You represent and warrant that You have the power and authority to enter into and bind such organisation.
- You acknowledge and agree that, as between Us and You, You are responsible for the acts or omissions of all persons accessing the MoodleCloud Services upon Your authority or permission (“Users”). You must ensure all Users accessing the MoodleCloud Services do so in accordance with these Terms.
- These Terms are subject to amendment from time to time. Any Amendments made will be published at moodlecloud.com and We will notify You of the same. You will be treated as having consented to the amended terms by continuing to access or use the MoodleCloud Services 28 days after the date of any such notice unless otherwise specified to You.
- OTHER TERMS AND CONDITIONS
- These Terms complement and hereby incorporate Our Privacy Notice, Cookies Policy and our Data Processing Agreement as set out on Our website at https://moodle.com/privacy-notice/.
- Your Users must agree to our Terms of Service and the policies outlined in 2.1.
- You may choose to use Third Party Products (defined below) offered with the MoodleCloud Services and their terms of service may apply to You.
- SERVICES
- Users can access and use MoodleCloud Services via the Website on any supporting computer, mobile, tablet or other device (“Device”). We only provide support to Users accessing the MoodleCloud Services via our recommended browsers.
- You can access and use MoodleCloud Services for a 28 day free trial or obtain additional features and functionalities, by purchasing a MoodleCloud Services package (Paid Package Service) and pay the applicable fees (Fees) for the specific plan period as set out on the Website. If You choose to include third party products and services that provide additional features or functionalities (Third Party Products) there may be additional fees as set out on the Website.
- To obtain access and use the MoodleCloud Services, You must complete the signup form to Moodle’s satisfaction and pay the requisite Fees.
- As part of Your MoodleCloud Services You can: (a) manage billing and amend the MoodleCloud Services required; (b) purchase Third Party Products; (c) delete or export Your MoodleCloud site(s); (d) view User and storage space use; and (e) contact Moodle Partners to obtain their services. You may assign and grant Users access to Your MoodleCloud site(s) and administer such Users and their capabilities in Your site.
- Your MoodleCloud site will be allocated a limited number of Users and a limited amount of storage space as set out on the Website subject to your chosen plan.
- If You have a “Free Forever” service, We will cease providing the MoodleCloud Services and delete Your MoodleCloud Site if Your MoodleCloud account is inactive for 14 days.
- Although We endeavour to ensure Third Party Products are maintained and updated on a regular basis, Moodle disclaims all responsibility and liability for the quality, reliability or failure of any Third Party Products.
- DATA
- Account information, including Personal Information or content (Data) that You or Users upload or submit to Your MoodleCloud site(s) may be processed and stored on servers outside Your country.
- We will not use, disclose or reference any Data except for support and training purposes in accordance with these Terms or as required for Us to provide or improve the MoodleCloud Services.
- You represent and warrant that:
- any and all Data You upload or submit via the MoodleCloud Services is Your sole and exclusive property; or
- You have secured any and all authorisation and rights to use such Data as applicable under relevant laws.
- You grant Moodle a licence to use, copy, transmit, store, process and back-up your Data, account information, Intellectual Property Rights and other related information:
- for the provision of MoodleCloud Services to You and Your Users and the performance of Our obligations under these Terms; and
- for research and development as required for the improvement of MoodleCloud Services.
- It is Your responsibility to maintain copies of all Data which You and a User uploads or submits via the MoodleCloud Services. We will use reasonable industry standards and procedures to prevent Data loss. However, as We utilise third party cloud-based services, We do not guarantee no loss of Data.
- If You purchase any Third Party Products, You acknowledge that We may allow such third parties to access any inputted Data as required for the interoperation of the Third Party Products to the MoodleCloud Services. We are not responsible for any disclosure, modification or deletion of Data resulting from any access by such third parties.
- You acknowledge and agree that:
- We are not responsible for any corruption or loss of any Data; and
- b. You are responsible for complying with all laws and regulations regarding the use and disclosure of Your Data including but not limited to the EU’s General Data Protection Regulation 2016/679, UK General Data Protection Regulation, the California Consumer Privacy Act 2018, the Australian Privacy Act 1988 (Cth), or other requirements under any corresponding foreign domestic law (“Privacy Laws”).
- We will use and maintain reasonable security systems for the transmission of Data, consisting of encryption and firewall technologies that are generally used in the cloud services sector to provide security for the transmission of such information over the Internet.
- AVAILABILITY MOODLECLOUD SERVICES
- We do not warrant that access to the MoodleCloud Services or Your Data will be available without interruption and at times such access may be unavailable due to maintenance or other development activity. You can check Our service level by accessing Our status page.
- Where possible, We will provide notice to You and the Users of any maintenance or development activity in advance via email and on our Website.
- SUPPORT
- We may provide limited technical support to You as set out on the Website and we will endeavour to respond to a support request within a reasonable period of time.
- We may refer You to a Moodle Certified Partner if You require specific, customised support. This may incur a support services fee.
- PAYMENT
- You agree to pay the requisite Fees upfront by way of credit card or PayPal to enable You to access and use the MoodleCloud Services.
- If You choose a Third Party Product and there are Fees are payable, You agree to pay the Third Party’s Fees upfront or as required to enable You to access and use the Third Party Product.
- You agree that We will automatically debit Your PayPal account or credit card to renew Your MoodleCloud Services unless You notify Moodle of Your cancelation of the MoodleCloud Services in writing with at least 30 days notice.
- Payment is due on the date of the invoice. If Your nominated payment method is declined We will notify You and automatically retry for up to 10 days. If payment has not been made within 10 days, Your MoodleCloud Services including MoodleCloud Sites may be suspended until payment is made or alternatively Your site may be deleted at Moodle’s sole discretion.
- Unless otherwise stated, all amounts are exclusive of Value Added Tax (VAT) or Goods and Services Tax (GST). VAT or GST will be specified and charged where applicable.
- CANCELLATION OF MOODLECLOUD SERVICES
- You may cancel Your MoodleCloud Services at any time. If You cancel Your MoodleCloud Services or Third Party Products, Your access will be terminated at the end of the current billing cycle, and automatic payments will cease at the end of Your current payment period.
- It is Your responsibility to retrieve all relevant Data from Your MoodleCloud Site(s) prior to termination.
- We may terminate the MoodleCloud Services immediately, at Our sole discretion, if:
- You breach any of these Terms not capable of remedy or You do not remedy a breach capable of remedy within 7 days of receiving notice to do so;
- We consider that the request for MoodleCloud Services is or was inappropriate, improper or unlawful;
- We believe You are insolvent or unable to pay Your debts as they fall due; or
- due to a Force Majeure event in accordance with clause 24.
- On termination of the MoodleCloud Services, We may retain certain Data as required by law or regulation.
- REFUND POLICY
- Subject to Your rights under the Australian Consumer Law, We may provide You with a refund of any Fees on a case-by-case basis and solely at Our discretion, including if the MoodleCloud Services are unavailable for an unreasonable period of time.
- Any cancellation, exchange or refund of a payment relating to a Third Party Product is strictly a matter between You and the relevant third party.
- USER OBLIGATIONS
- You warrant that all information provided to Moodle is true, accurate and complete.
- You acknowledge and agree You are responsible for how the Users use the MoodleCloud Services and that:
- You and each User uses the MoodleCloud Services at Your own risk;
- all usernames and passwords required to access the MoodleCloud Services are kept secure and confidential;
- if there is any unauthorised use of Your password or any other breach of security, You will immediately notify Moodle of such activity;
- the accessibility and reliability of the MoodleCloud Services is dependent upon Your and each User's choice of web-browser, internet connection, Device, Device operating system other hardware and their settings;
- it is Your responsibility to determine that the MoodleCloud Services meet Your needs and Your business and are suitable for the purposes for which the MoodleCloud Services are used;
- You are responsible for obtaining any consents, licences, permits and permissions from other parties as required for the MoodleCloud Services to be provided including content within Your MoodleCloud Site, at Your cost, and for providing Us with the necessary consents, licences and permissions upon request; and
- You will cooperate with Us and provide Us, as reasonably requested by Us from time to time, with information about Your Device and/or access to Your Data as is reasonably necessary to enable Us to perform the MoodleCloud Services and comply with these requests in a timely manner.
- You acknowledge and agree that:
- each User is authorised to use the MoodleCloud Services and access or input any Data into the MoodleCloud Site or provide such Data to Us as required for the MoodleCloud Services;
- You will procure each User to use the MoodleCloud Services in a lawful manner and in accordance with these Terms; and
- MoodleCloud Services may include Third Party Products and services. Your use of MoodleCloud Services may be subject to additional terms with such Third Parties. Where You use a Third Party Product, any such terms are solely between You and the third party.
- We are not responsible to any person or entity other than You and nothing in these Terms confers, or purports to confer, a benefit on any other person or entity. If You use the MoodleCloud Services on behalf of or for the benefit of any third party, You agree that:
- You are responsible for ensuring that You have the right to do so;
- We do not warrant the fitness for purpose or suitability of the MoodleCloud Services for such third party's purposes and third parties may not rely on Moodle for any purpose;
- You are responsible for authorising any person who is given access to Your Data, and You agree that We have no obligation to provide any person or entity with access to such Data without authorisation from You and may refer any requests for access to the Data to You to address; and
- You will indemnify Moodle, on first demand, against any and all claims, expenses, liabilities or losses arising out of in connection with Our refusal to provide any persons with access to Data in accordance with these Terms or Moodle making Data available to any person with authorisation from You.
- You remain solely responsible for complying with all applicable laws. It is Your responsibility to ensure that the storage of and access to Your Data via the MoodleCloud Services and Website comply with laws which are applicable to You, including any laws requiring You to retain records of Your Data.
- Each User must have their own safeguards and back-up processes in place to recover from any failures or loss of Data which might occur whilst using the MoodleCloud Services and protecting the confidentiality of Your Data with suitable management procedures, as You may see fit.
- PROHIBITED USE
- You acknowledge and agree that You and each User will not:
- attempt to circumvent or disable the Website or any technology features or measures in the Website by any means or in any manner;
- attempt to modify, copy, adapt or reproduce the Website except as necessary to use it as represented by Us to You;
- distribute, encumber, sell, rent, lease, sub-licence, or otherwise transfer, publish or disclose the MoodleCloud Services to any third party (except as permitted under these Terms) or with our permission;
- remove or alter any trademark, logo, copyright or other proprietary notices, legends, symbols or labels on the Website or used in connection with the MoodleCloud Services;
- use the MoodleCloud Services in any manner to aid in the violation of any third party Intellectual Property Rights;
- take any action that interferes, in any manner, with Our rights with respect to the MoodleCloud Services;
- upload any products or services offered by third parties, including any plugins other than providing access to an externally-located Third Party product through selecting an activity within a course using the external tool feature;
- attempt to undermine the security or integrity of the MoodleCloud Services, servers, computing systems or a third party's computing systems and networks hosting the MoodleCloud Services;
- attempt to gain unauthorised access to any materials other than those to which You have been given express permission to access; and
- transmit, or input into the Website, any files that may damage any other person's computing devices or software, content that may be offensive, or material or Data in violation of any law (including any content protected by copyright or trade secrets which You do not have the right to use).
- You must not, and You must ensure each User does not, post, upload, publish, submit or transmit any content that:
- infringes, misappropriates or violates any third party Intellectual Property Rights, publicity rights or Privacy Laws;
- is fraudulent, false, misleading or deceptive;
- denigrates Moodle or the MoodleCloud Services;
- violates, or encourages any conduct that would violate, any applicable law or regulation or would give rise to civil liability;
- is defamatory, obscene, pornographic, vulgar, offensive, promotes discrimination, bigotry, racism, hatred, harassment or harm against any individual or group;
- is violent or threatening or promotes violence or actions that are threatening to any other person; or
- promotes illegal or harmful activities or substances.
- Ownership and Intellectual Property Rights in any content displayed or accessed through the Website, is the property of the applicable content owner. These Terms do not purport to extend any rights to any content which You do not own.
- Any breach of this clause will entitle Moodle, at its discretion, to suspend or terminate Your access to Your MoodleCloud Services.
- You acknowledge and agree that You and each User will not:
- INTELLECTUAL PROPERTY
- In these Terms Intellectual Property Rights includes any and all intellectual and industrial property rights throughout the world, whether subsisting now or in the future and includes all copyright and analogous rights, all rights in relation to inventions (including patent rights), registered and unregistered trademarks, designs (whether or not registered or registrable), circuit layouts, trade names, trade secrets, business names, company names or internet domain names.
- Title and ownership to all Intellectual Property Rights in the MoodleCloud Services and related documentation remains Our property and the property of Our successors and permitted assigns. Your right to use such Intellectual Property is subject to these Terms.
- Subject to these Terms, We grant You a personal, non-exclusive, non-transferable, limited, revocable licence to use and access the MoodleCloud Services in accordance with these Terms.
- Title to and all Intellectual Property Rights in any Data You input into MoodleCloud Services remain Your property. However, Your access to such Data stored is contingent on Your ongoing payment of Fees.
- You grant Moodle a licence to use, copy, transmit, store, and back-up Your information and Data for the purposes of enabling You to access and use the MoodleCloud Services and the performance of Our obligations under these Terms.
- DISPUTE RESOLUTION
- Any feedback should be provided to Us using the relevant contact form as set out on the Website.
- Any dispute concerning these Terms or the access or use of MoodleCloud Services must be initiated in accordance with the following dispute resolution procedure:
- the complainant must outline the dispute and outcome sought in writing, within 28 days of the circumstances giving rise to the dispute (“Dispute Notice”).
- The Parties agree to meet in good faith to seek to resolve the dispute within 28 days of the Dispute Notice.
- If the Parties cannot resolve the dispute within 60 days either Party may pursue the matter at its sole discretion.
- Any attempts made by the Parties to resolve a dispute pursuant to this clause are without prejudice to other rights or entitlements of the Parties under these Terms, by law or in equity.
- AUSTRALIAN CONSUMER LAW
- Certain legislation including the Australian Consumer Law (ACL) in the Competition and Consumer Act 2010 (Cth), and similar consumer protection laws and regulations may confer You with rights, warranties, guarantees and remedies relating to the provision of MoodleCloud Services by Moodle to You which cannot be excluded, restricted or modified (“Statutory Rights”).
- If You are a consumer under the ACL, nothing in these Terms removes or is intended to restrict Your Statutory Rights. You agree that Our liability for MoodleCloud Services provided to consumers is governed solely by the ACL and these Terms. We exclude all conditions and warranties implied by custom, law or statute except for Your Statutory Rights.
- Except for Your Statutory Rights, all material and work is provided to You without warranties of any kind, either express or implied; and We expressly disclaim all warranties of any kind including but not limited to implied warranties of merchantability and fitness for a particular purpose.
- If You are a consumer as defined in the ACL, the following applies to You: We guarantee that the services We supply to You are rendered with due care and skill; fit for the purpose that We advertise, or that You have told Us You are acquiring the services for or for a result which You have told Us You wish the services achieve, unless We consider and disclose that this purpose is not achievable; and will be supplied within a reasonable time. To the extent We are unable to exclude liability; Our total liability for loss or damage You suffer or incur from MoodleCloud Services are limited to Us re-supplying the services to You, or, at Our option, Us refunding toYou the amount You have paid Us for the services to which Your claim relates.
- LIMITATION OF LIABILITY AND DISCLAIMERS
- The Parties agree that, Our liability for the MoodleCloud Services is governed solely by the Australian Consumer Law and these Terms
- You acknowledge that while We will take reasonable steps to ensure that the MoodleCloud Services will be fit for the purposes as advertised, We do not guarantee that:
- the MoodleCloud Services will meet Your specific requirements;
- the MoodleCloud Services will work in each of Your desired use case scenarios; and
- the MoodleCloud Services are able to be executed on all operating systems.
- The MoodleCloud Services use third party services including third party hosting services which are provided without any sort of warranties, and We cannot ensure that these third party hosting services are provided free of defect or without interruption.
- We do not warrant that use of MoodleCloud Services or Website will be uninterrupted or error free. The operation of MoodleCloud Services and Website is dependent on third party hosting services and Internet connectivity which can be unpredictable from time to time and limit Your use of the MoodleCloud Services.
- All risk arising out of the use or performance of MoodleCloud Services remains with You. You understand and agree that the use of the MoodleCloud Services, material or data downloaded or otherwise obtained through the use of the MoodleCloud Services, is at Your own discretion and risk and that You will be solely responsible for any infections, contaminations or damage to Your computer, system or network. We are not responsible or liable for delays, inaccuracies, errors or omissions arising out of Your use of the MoodleCloud Services or any third party software or operating system.
- To the maximum extent permitted by law, We disclaim all warranties, express or implied, including, without limitation, any implied warranties of merchantability, fitness for a particular purpose and non-infringement of third party intellectual property rights or lack of viruses, for the MoodleCloud Services. In no event will We be liable for any consequential, incidental, indirect, special, punitive, or other damages whatsoever arising out of these Terms, the use of or inability to use the MoodleCloud Services or Website, even if We were advised of the possibility of such damages.
- You acknowledge that We may pursue any available equitable or other remedy against You as a result of a breach by You of any provision of these Terms.
- Our liability for breach of any obligations under these Terms, or breach of any warranty implied by law, will be limited, to the extent permitted by law, to the total price paid by You for the MoodleCloud Services. Our total liability to You for all damages in connection with the MoodleCloud Services will not exceed the price paid by You under these Terms for the 12 months period prior to the act which gave rise to the liability. The foregoing limitations, exclusions and disclaimers will apply to the maximum extent permitted by applicable law, even if any remedy fails its essential purpose.
- You acknowledge and agree that We will not be liable for any non-compensatory damages including punitive, aggravated, multiple, exemplary, liquidated or any other non-compensatory damages or the consequences of non-payment.
- INDEMNITY
- You will be liable for and agree to indemnify, defend and hold Moodle harmless for and against any and all claims, liabilities, suits, actions and expenses, including costs of litigation and reasonable legal costs, resulting directly or indirectly from: (i) any information that is not accurate, up to date or complete or is misleading or a misrepresentation; (ii) any breach of these Terms; (iii) and any misuse of the MoodleCloud Services or Website; from or by You, Your Users, Your employees, contractors or agents.
- You agree to cooperate with Moodle (at Your own expense) in the handling of disputes, complaints, investigations or litigation that arise as a result of Your use of the MoodleCloud Services including but not limited to disputes, complaints, investigations or litigation that arises out of or relates to incorrect information You have given Us.
- The obligations under this clause will survive termination of these Terms.
- NOTICE
- Any notice required or permitted to be given to the User under these Terms will be addressed to the User at the email address provided by the User.
- FORCE MAJEURE
- If performance of these Terms or any obligation under these Terms is prevented, restricted, or interfered with by causes beyond either party's reasonable control (Force Majeure), and if the party unable to carry out its obligations gives the other party prompt written notice of such event, then the obligations of the party invoking this provision shall be suspended to the extent necessary by such event. The term Force Majeure shall include, without limitation, acts of God, fire, explosion, vandalism, pandemics, epidemics, storm or other similar occurrence, orders of acts of military or civil authority, or by national emergencies, insurrections, riots, or wars, or strikes, lock-outs, work stoppages. The excused party shall use reasonable efforts under the circumstances to avoid or remove such causes of non-performance and shall proceed to perform with reasonable dispatch whenever such causes are removed or ceased. An act or omission shall be deemed within the reasonable control of a party if committed, omitted, or caused by such party, or its employees, officers, agents, or affiliates.
- ENFORCEABILITY
- If any provision of these Terms is held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the other provisions of these Terms and the remainder of the provisions in question will not be affected.
- ENTIRE AGREEMENT AND UNDERSTANDING
- In respect of the subject matter of these Terms:
- these Terms contain the entire understanding between the Parties; and
- all previous oral and written communications, representations, warranties or commitments are superseded by these Terms and do not affect the interpretation or meaning of these Terms.
- In respect of the subject matter of these Terms:
- GOVERNING LAW AND JURISDICTION
- These Terms are governed by the laws of Western Australia and the federal laws of the Commonwealth of Australia. Each Party irrevocably and unconditionally submits to the exclusive jurisdiction of the courts operating in Western Australia.
